⚖️ Court of Appeal Issues Notices in Challenge to Mannar Wind Power Project

Source

The Court of Appeal has permitted a writ application by the Wildlife and Nature Protection Society (WNPS) to proceed regarding the Phase I Extension of the Thambapavani Wind Power Project on Mannar Island. Notices have been directed to the Respondents, including parties taking over former Ceylon Electricity Board (CEB) operations. • Legal & Regulatory Compliance: The WNPS contends that the project violated mandatory statutory procedures under the National Environmental Act and the Coast Conservation Act, alleging wind turbines are being built in unapproved locations and in excess of approved limits. • Environmental Impact: Mannar Island is a Key Biodiversity Area along the Central Asian Flyway. The application highlights that turbines were installed in "very high risk" zones identified in the project's own Avifaunal Study, posing severe threats to migratory birds, coastal habitats, and local livelihoods near protected zones like the Vankalai Sanctuary. • Energy Sector Context: WNPS emphasized its support for Sri Lanka's renewable energy transition, maintaining that green energy development must strictly align with environmental safeguards and legal compliance.
